法律规则或者书本上的法律并不能自然而然完成立法者的主观意图或实现调整社会关系的功能,因为法律的实现总是受着社会中各种已知或未知因素的影响。在一系列拆迁案矛盾中,《城市拆迁管理条例》与《物权法》、《宪法》发生了不少冲突。作者从法理和实际情况出发,进行了分析并提出了解决方案。
Legal rules or laws in books do not automatically fulfill the legislator’s subjective intent or adjust the social relations function, because the realization of law is always affected by all kinds of known or unknown factors in society. In a series of contradictions in demolition cases, there have been many conflicts between the Regulations on the Administration of Urban Demolition and the Real Right Law and the Constitution. Based on the jurisprudence and the actual situation, the author carried out an analysis and proposed a solution.
