在犯罪学视野里,体育有伤风化犯罪是指在体育活动中采用卑劣、下流手段,无理取闹、为非作歹,严重扰乱公共秩序,带有社会危害性的行为。体育有伤风化行为表现为语言暴力行为和身体暴力行为两大类,其中语言暴力行为又分为话语型和肢体语言型,带有身体暴力性质的行为主要有寻衅滋事、聚众斗殴以及涉性行为几种类型。体育有伤风化犯罪的产生有其社会根源,主要来自文化、心理、经济、政治、自然以及法律等方面,还受个体因素影响。对于体育有伤风化犯罪,应采取形式多样、层次鲜明的应对策略,一般分为预防、控制和处罚三个阶段,其中,处罚应当限定在法律框架内。
