一直以来对行政诉讼性质就存在主观诉讼和客观诉讼的争辩。从行政纠纷的多样性、行政诉讼发展规律以及十八届三中全会后强调法院在法治建设中的作用来看,转变法院职能,从纠纷解决者转向权力监督者,行政诉讼客观化是今后行政诉讼发展的主要走向。2014年修改的行政诉讼法第12条第8项首次以立法的形式将行政垄断纳入受案范围,确立了反行政垄断诉讼类型。而反行政垄断诉讼背后蕴含的价值追求与具体的审理规则都显现出行政诉讼客观性的特质。由此可得出反行政垄断诉讼客观化的发展现状、瓶颈、契机,其实就是我国行政诉讼客观化发展状况的真实写照。
The nature of administrative litigation has always been a subjective litigation and objective lawsuit debate. From the diversity of administrative disputes, the law of development of administrative litigation and the role of the court after the Third Plenary Session of the 18th CPC Central Committee in emphasizing the construction of the rule of law, changing the function of the court and turning it from the dispute settler to the power supervisor, the administrative lawsuit objectivity is the future administration The main trend of litigation development. Article 12, Item 8 of the Administrative Procedure Law, amended in 2014, for the first time incorporates administrative monopoly into the scope of accepting cases in the form of legislation and establishes the type of anti-administrative monopoly proceedings. However, the pursuit of value and the specific rules of trial contained in the anti-administrative monopoly litigation have all shown the objectivity of administrative litigation. From this, we can draw a conclusion that the development objective, the bottleneck and the turning point of the anti-administrative monopoly lawsuit are in fact a true portrayal of the objective development of administrative litigation in our country.
