本文拟从法院体系内实际运行的权力入手,分析这些权力的运转规律对法院组织体系的影响。通过对法院体系内权力运行特点的理论分析,以及研究这些权力与法院组织体系的相互关系,从而为现有法院组织体系的调整和完善提供一个相对成熟的理论依据,并对中国法院组织体系内的权力运转现状进行分析,指出对现有法院组织体系进行变革和完善的基本思路和原则,探讨对法院组织体系改革的具体设想。
