“邓玉娇案”引发了对警察解释行为的关注,警察行为代表了国家权力,警察的不当解释破坏了政府的公信力,造成了大众对刑事侦查的信任危机。警察解释具有职权性、回应性、不确定性和事实性的特点。规范的警察解释需要坚持公共立场,防止地方权力干预,运用正当程序进行解释,还需要全面提高警察的素质。警察在刑事侦查中,依据案件的被关注程度与案件的隐私状况作出不同的解释,可以节约司法成本,实现解释的法律效果与社会效果的统一。
“Deng Yujiao case ” triggered concern about the police interpretation of behavior, police acts on behalf of the state power, the police improper interpretation undermined the credibility of the government, resulting in a public crisis of confidence in criminal investigations. Police explained the characteristics of authority, responsiveness, uncertainty and factuality. Normative police need to uphold the public stance, prevent local power interference and justify due process. They also need to improve the overall quality of the police. In the criminal investigation, the police make different explanations according to the degree of concern of the case and the privacy status of the case, which can save the judicial cost and achieve the unification of the legal effect and the social effect of interpretation.
