企业在濒临破产或生产经营状况发生严重困难,确需裁减人员时,对本单位的富余人员可以裁减。这是《劳动法》赋予用人单位的一项基本权利。据调查,个别企业在行使这一权利时,存在不同程度的违法违规现象。表现在以下几方面:一、裁员的随意性大。用人单位经济性裁员,根据《劳动法》第二十七条规定:“用人单位濒临破产进行法定整顿期间或者生产经营状况发生严重困难,确需裁减人员的,应当提前三十日向工会或者全体职工说明情况,听取工会或者职工的意见。”个别企业的做法未履行法定的“听取意见”程序;有的企业只是从形式上提前召开了职代会,让职工学习裁员文件,实质上对职工或工会对裁
