本文认为对于明知自己是艾滋病患者而卖淫、嫖娼的行为应该设立故意传播艾滋病罪,根据犯罪的不同情形规制不同的法定刑。行为人误以为自己患有艾滋病而实施以传播艾滋病病毒为目的的犯罪,行为人犯罪的未遂实际上是对状态的认识错误,应当在工具不能犯未遂和对象不能犯未遂之外承认状态不能犯未遂的存在。如果行为人是在并非明知自己患有艾滋病的情况下致使他人感染艾滋病的,根据不同的主观因素,对非明知自己患有艾滋病使他人感染艾滋病的行为可以作出不同的定性。
