随着社会文明程度的发展以及人权、法制观念的深入人心,社会保障的理念逐渐被人们所重视。近几年来,理论界掀起了保护和救济刑事被害人的热潮,这对完善我国社会保障体系,健全社会保障立法研究起到很大的作用。但是,理论界多提议建立刑事被害人国家补偿制度,建立刑事被害人国家补偿方面的立法。本文建议我国应根据实际情况,先对刑事被害人进行救助,建立刑事被害人救助方面的立法。
With the development of social civilization and the deepening popularity of human rights and legal system concepts, the concept of social security has gradually been taken seriously by people. In recent years, the theoretical circles have set off a wave of protection and relief of criminal victims, which plays a great role in perfecting the social security system in our country and improving the study of social security legislation. However, theorists mostly propose to establish a national compensation system for criminal victims and establish legislation on the compensation of criminal victims. This paper suggests that our country should, according to the actual situation, first aid the criminal victims and establish the legislation on the assistance of criminal victims.
