一、我国房地产经纪业的发育90年代以来,尤其是1992年党的“十四”大提出要发展房地产市场之后,我国的房地产经纪业有了较为广阔的发展空间.随着《城市房地产管理法》(以下简称“房地产法”)的颁布和实施,房地产经纪制度开始确立,经纪市场不断扩大,经纪队伍和经纪机构得到较快的发展.房地产经纪业的初步发育为活跃房地产市场,促进房地产流通发挥了积极的作用.但是,作为一个新兴的行业在初步显示其生命力的同时,由于发展时间不长仍然存在着一些不可避免且又不容忽视的问题.1、环境不适在欧美国家,房地产经纪业是以成熟的市场经济和房地产市场作为大环境,而我国的房地产经纪业产生和发展于计划经济向市场经济过渡的时期,这一时期房地产业的市场化程度还不高,因而有利于房地产经纪业发育的外部环境尚未完全形成.(1)法制环境有差距.1994年以前我国房地产经纪方面的法律法规几乎是空白.1994年7月颁布“房地产法”才开始为构建房地产经纪业的法律框架打基础.其后,建设部发布《城市房地产中介服务管理规定》(即50号令),并与国家计委下发《关于房地产
