行政取缔的法律属性是行政处罚还是行政强制,学术和实务界一直存在争论。作者认为,争论产生和存在的原因是取缔基础理论的研究不足和取缔研究方向的偏倚。因此,本文在分析取缔与禁止性规范、行政许可的关系,阐述取缔对象的概念、取缔目的行为系统及其之间的关系问题后,提出取缔的本质不是行政处罚,也不是行政强制,而是有权行政机关对取缔对象存在的否定意见表示,并通过综合运用行政强制(查封、暂扣)、行政处罚(收缴、没收违法所得)、行政命令(公告禁止)等多种行政行为组成的取缔行为系统,以实现否定取缔对象,恢复、稳定和延续法定行政管理秩序的目的。
Whether the legal nature of administrative ban is administrative punishments or administrative coercion has always been a controversial issue between academics and practitioners. The author believes that the reasons for the emergence and existence of the controversy are the suppression of the insufficiency of the basic theory and the suppression of the bias of the research direction.
