《中华人民共和国物权法》在总结实践经验的基础上,对不合时宜的司法理念、民法理论和法律规范进行了修正,并对物权制度的共性问题和现实中迫切需要规范的问题作出了规定。抵押权作为物权的重要组成部分,在《物权法》中专章作出了规定、补充、修改和完善,这就使物权法与担保法的相关规定发生一定的重叠甚至冲突。为了突出《物权法》的法律地位,其第一百七十八条对此作了原则性规定:“担保法与本法的规定
