2011年9月16日,美国总统奥巴马签署了《美国发明法案》,这标志着美国自1952年以来最大规模的专利改革法案得到通过,同时这也是美国在近60年的专利改革发展的进程中迈出了里程碑式的一步。美国作为世界上最发达的国家也是最早实行专利法制度的国家之一,注重运用保护性政策促进创新性活动,所以它的一举一动都牵动着全世界的目光。《美国发明法案》对美国专利法的修订涉及专利实体法,专利申请程序以及专利机构改革多个方面。美国专利制度的改革必将对专利法的国际协调和专利制度产生重大影响。随着我国知识产权战略的不断推进,我国的专利申请量逐年递增,美国专利法的改革将对我国专利制度产生怎样的影响,是值得密切关注和研究的问题。
