近几年来,随着房地产市场的升温,城市的外延在不断扩大,因此对城市周边农村土地不断征用就形成了拆迁工作中的一个重要内容——农转非(无地队)拆迁。农转非,有的地方叫无地队,但不管叫什么名称,其内容都是一样的,就是国家征用了农民的集体土地用于城市建设,对这部分拆迁对象,笔者认为,其安置补偿办法应与城区房屋有所区别,不能一刀切。如笔者所在城市制定的拆迁管理条例规定:“非成套房以《房屋所有权证》记载的建筑面积按照1:1.17的比例换算成安置结算的原建筑面积。”在实际操作中我们认为把这条规定运用于农转非(无地队)拆迁是极不合理的,对此提出质疑,供其他地方城区在制订、修改地方法规时参考,使地方性法规更加合理、完善。
