劳动就业,是每个人维系生活的重要手段。我国宪法规定每个公民都享有就业的权利。但是作为特殊群体,其在社会的运行过程的始终处于弱势地位。尤其是由于其自身心理或生理等条件的限制,在劳动就业中问题尤为突出。同时作为特殊人群中的残疾人,在就业市场中的权利无法得到实现及确保,侵犯残疾人就业权利的现象广泛存在。当今残疾人劳动就业问题对于构建和谐社会有着极其重要价值意义,也是衡量一个国家民主程度和法治程度的重要标准。促进残疾人就业,有利于残疾人经济及精神生活状态的改善,同时也利于其社会地位的提高等。因此对于我国残疾人这一类特殊人群的劳动就业法律保障问题的研究有着重要社会价值意义。
Labor and employment, is an important means of life for everyone. Our Constitution stipulates that every citizen has the right to employment. However, as a special group, its operation process in society has always been in a weak position. Especially due to its own psychological or physiological conditions, the problem is particularly prominent in employment. At the same time, as a disabled person in a special population, the rights in the job market can not be realized and ensured, and violations of the employment rights of persons with disabilities are widespread. At present, the issue of employment and employment for handicapped people is of great significance to the construction of a harmonious society and an important criterion for measuring the degree of democracy and the rule of law in a country. Promoting the employment of persons with disabilities is conducive to the improvement of the economic and spiritual living conditions of persons with disabilities and at the same time facilitates the improvement of their social status. Therefore, it is of great social significance to study the legal protection of employment of special categories of people with disabilities in our country.
