近日,笔者从某用人单位行政惩处公文上看到,对职工违规违纪行为的行政处分引用了“开除留用”词句,使人辨别不清到底是“开除”还是“留用”。本人认为“开除留用”行政处分不符合法律用语,易引发劳动争议纠纷,应予以纠正。正确法律用语应是“留用察看”行政处分。
Recently, the author saw from an official punishment document of an employing unit that the administrative sanction of violation of discipline and discipline by employees quoted the phrase of “expulsion and reservation”, making it difficult to distinguish between “expelled” or “retained” . In my opinion, the administrative disposition “expelled from reserve” does not conform to the legal language and can easily lead to disputes over labor disputes and should be rectified.
