一、问题的提出改革开放以来,随着我国社会向市场经济体制转型,传统的劳动关系已经发生了深刻变化,正在向劳动关系类型多元化、复杂化方向嬗变,新型劳动关系体制建设亦取得了长足进展。目前我国经济正处于从总量扩张到结构调整的发展阶段,尽管劳动关系基本是和谐稳定的,但在一些地区、行业和企事业单位中,影响职工合法权益实现、影响劳动关系健康发展的问题还不同程度的存在(吴宏洛,2007)。
