我国正处于社会转型期,“见危不扶”“见死不救”“道德绑架”等道德危机事件层出不穷。深入探索社会转型期道德危机的化解路径,是我们面临的一个重大课题。自然主义法学派认为,道德与法律存在密切联系,道德为法律创新提供内在动力,法律标准应该顺从道德标准。从这个视角来看,在处理违反道德标准但未触及法律制裁标准事件的时候,也可以将道德问题转化为法律规则进行裁决。由此而来,社会转型期道德危机的化解路径,应该尝试推行一定范围的道德法律化。与此同时,要大力弘扬民族传统文化,着力提高公民素质;强化新闻媒体工作者的责任意识,通过创新新闻报道方式传播正能量。 Our country is in a period of social transition. There are many moral crises such as “not being at risk”, “being dead on the ground”, “moral abduction” being held by others. Further exploration of the path of resolving the moral crisis during the social transformation is an important issue we face. The naturalist school believes that there is a close relationship between morality and law, morality provides internal motivation for legal innovation, and legal standards should conform to moral standards. From this perspective, ethical issues can also be translated into legal rules for adjudication when dealing with violations of ethical standards but without reaching the standard of legal sanctions. As a result, the path of resolving the moral crisis during the social transition should try to promote a certain range of moral law. At the same time, we must vigorously carry forward the traditional national culture and make every effort to improve the quality of citizens. We must reinforce the sense of responsibility of news media workers and spread positive energy through innovative news reporting.
