各省、自治区、直辖市高级人民法院,解放军军事法院,新疆维吾尔自治区高级人民法院生产建设兵团分院: 近年来,一些地方人民法院在审理涉及国有大中型企业债权纠纷案件过程中发现,由于目前我国正处于社会主义市场经济完善阶段,社会信用制度尚不健全,一些国有大中型企业因为债权难以实现,导致资金流转不畅、经营管理困难,甚至严重影响了这些企业的生存。一些法院在法律适用、强制执行、审判效率、工作方式等方面也存在一些问题,难以适应我国国有大中型企业改革和发展的需要。为加强涉及国有大中型企业债权纠纷案件的审判工作,维护国有大中型企业和其他当事人的合法权益,防止国有资产流失或者被非法侵占,现作如下通知:
In recent years, some local people’s courts found during the hearing of the case involving the claims of state-owned large and medium-sized enterprises that due to the fact that at present our country is in the process of adjudicating cases of claims involving large and medium-sized state-owned enterprises, the people’s courts of the provinces, autonomous regions and municipalities directly under the Central Government, the military courts of the People’s Liberation Army and branches of the production and construction corps of the Higher People’s Court of Xinjiang Uygur Autonomous Region In the stage of perfecting the socialist market economy, the social credit system is still not perfect. Some large and medium-sized state-owned enterprises are hard to realize because of their claims, leading to poor capital flow and difficulties in operation and management and even seriously affected the survival of these enterprises. Some courts also have some problems in law application, enforcement, trial efficiency and working methods, which make it difficult to meet the needs of the reform and development of the state-owned large and medium-sized enterprises in our country. In order to strengthen the adjudication of cases concerning disputes over claims of state-owned large and medium-sized enterprises, safeguard the legitimate rights and interests of large and medium-sized state-owned enterprises and other parties, and prevent the loss of state assets or illegal encroachment, we hereby notify you as follows:
