权利失效原则是大陆法系国家通过判例确立的一项重要原则,是诚实信用原则的具体体现。权利失效原则对于克服诉讼时效制度的僵化,弥补除斥期间制度的不足,维护交易的安全与秩序起着重要的作用。本文从权利失效原则的构成要件、适用范围和法律效力方面进行考察,认为在我国也应确立这一原则。
The principle of invalidation of rights is an important principle established by civil law countries through case law and is the concrete manifestation of the principle of good faith. The principle of invalidation of rights plays an important role in overcoming the rigidification of the limitation of action system, making up the deficiencies in the system of exclusion and safeguarding the security and order of the transaction. This article examines the constitutional elements, scope of application and legal validity of the principle of invalidation of rights, and holds that this principle should also be established in our country.
