目前我国关于军事犯罪认定的有关法律规定需要进一步的完善,无论是采取在立法上完善现行的军事犯罪体系,还是将其从现行立法中剥离出去,确立单独的军事法典或者是出台单独的军事犯罪认定法规,都将有助于我国军事犯罪认定的准确性的提高。本文将从国内外军事犯罪的立法现状出发,探讨我国目前军事犯罪立法现状所存在的不足以及相对应的立法建议。
