建国初期检察机关的法律监督包括一般监督和司法监督,而其中最重要的一般监督由于当时条件的限制而被空置(并非学界所普遍认为的已被取消),在制度历史惯性的作用下,这项制度已鲜有人提及。当前所见关于一般监督制度的零星论述均未能系统再现这项重要检察制度的基本理论,笔者认为对此项制度理论研究上的缺失,正是造成当前检察理论和实践混乱的重要根源。因此,对一般监督理论进行探析将有利于正确认识我国的检察制度。
In the early years of the founding of PRC, the legal supervision of the procuratorial organs included general supervision and judicial supervision. The most important general supervision was vacant due to the restriction of the conditions at that time (it was not generally accepted as having been canceled in the academic circles). Under the institutional inertia of history, The system has rarely been mentioned. The current sporadic discourse on the general supervision system fails to systematically reproduce the basic theory of this important prosecutorial system. The author believes that the lack of theoretical research on this system is precisely the root cause of the current confusion in procuratorial theory and practice. Therefore, the analysis of the general supervision theory will be conducive to a correct understanding of our procuratorial system.
