我国历史上存在绝然相反的两种法官形象:他们在道德上贪赃枉法、腐败堕落……;他们在业务上技术娴熟、考量周全……。长期以来,人们谈论古代的法官时也各取所需,各有侧重。这种思维定势直到今天仍然影响着人们对法官的评价,阻碍着现代法官形象建设。为了探求现代法官形象的建立路径,本文以文化人类学的自我阐释权剥夺理论为分析工具,初步探究了法官形象出现两种历史记忆的根源及其现代启示,并请教方家。
There are two diametrically opposed judges in our history: they are ethically corrupt and corrupt ... they are highly skilled and well-thought-out in business ....
