宪法事例的出现是与法学回归实践教学的背景密切相连的。法学实践教学最常用的方式是案例教学。就民法、刑法、行政法、诉讼法等部门法而言,法学案例数量众多、内容丰富,已有成熟的教学案例素材和方法。但是,由于宪法根本大法的性质,即使在宪法有适用效力的国家,宪法案例也比其他部门法少。而在我国目前宪法尚无实际适用效力的背景下,宪法案例教学根本没有操作的土壤。虽然在我国宪法通常不直接解决现实问题,但是法治建设的目标就是宪法价值的实现。这一点已经在我国近年来针对社会问题
The emergence of the constitutional case is closely linked with the background of the return of law to practice teaching. The most commonly used method of law practice teaching is case teaching. As far as the law of civil law, criminal law, administrative law and procedural law are concerned, there are a large number of jurisprudence cases and rich content. There are already mature teaching case materials and methods. However, due to the nature of the fundamental law of the Constitution, even in countries where the constitution is applicable, there are fewer constitutional cases than those in other sectors. However, under the current situation that there is no practical validity of the constitution in our country, there is no soil for the operation of the constitutional case teaching at all. Although the constitutional law in our country usually does not directly solve the real problems, the goal of constructing the rule of law is to realize the constitutional value. This point has been directed at social issues in our country in recent years
