普通垄断行为受到《反垄断法》的规制,制度性垄断行为“反制”反垄断制度。制度性垄断行为源于垄断制度对特殊权力制衡的缺乏,发展于由此导致的各种社会利益冲突,表现为市场竞争环境的改变。由此所形成的反垄断制度的发展表现为反垄断制度局部适用的调整,重组各方权利义务关系乃至改变反垄断制度的基本理念,从而形成规制对象与归责原则在不同层面上的区别。
Ordinary monopoly behavior is regulated by the “Anti-monopoly Law” and institutional monopoly behavior “anti-control” antitrust system. Institutional monopolistic behavior stems from the lack of checks and balances on special powers by the monopoly system. It develops in various social conflicts resulting from it, and manifests itself as changes in the market competition environment. The resulting development of antitrust regimes shows that the antitrust regime applies locally to adjust, restructure the rights and obligations of all parties and even change the basic idea of the antitrust regime, so as to form the difference between the regulatory object and imputation principle at different levels.
