只有建立起法治政府,才能科学界分政府与社会的权力边界,充分保障社会的自治活力与公民权利的生长。对权力的制衡与约束、对权利的主张与保护是法治的两大核心主线,只有实现权力的约束才能达到对权利的保护。政府基于公民权利而存在,法治通过对政府权力的规范,既确保公权力为私权利服务,又防范公权膨胀损害私权。所以,建设法治政府是建设法治国家、保障公民权利的重中之重。政府权力能否被关进制度笼子、政府公共治理和管理社会的方式是否合乎法治要求、行政执法对待公民权利的态度、行政部门执行法律法规的效果等,都是衡量国家法治状况的核心要素。
Only by establishing a government under the rule of law can the scientific community be separated from the power boundary between the government and society and the social autonomy and the growth of civil rights can be fully guaranteed. The checks and balances on power, the claim and protection of rights are the two main core lines of the rule of law, and the protection of rights can only be achieved by the restraint of power. The government exists on the basis of citizens’ rights. Through the standardization of government power, the rule of law not only ensures that the public power serves the private rights, but also prevents the expansion of public power from damaging the private rights. Therefore, building a government ruled by law is the most important task in building a state under the rule of law and safeguarding citizens’ rights. Whether the power of government can be locked into the system cage, how the government public manages and manages the society is in conformity with the rule of law, whether the attitude of administrative law enforcement to citizen rights or the effectiveness of administrative departments in enforcing laws and regulations are the core elements to weigh the state of law in our country.
