刑法上的因果关系不同于哲学上的因果关系,因为刑法中的因果关系是用以明确一个具体行为与损害结果之间的联系。这种特殊的因果关系的明确是确定最终行为人应受刑法惩罚的前提条件。法律不会处罚一个与危害结果无关的行为人,也不会轻易排除对一个与危害结果有关行为人的处罚的可能。因而其要求比哲学上的因果关系更严密,不容疏忽。本文通过肯定中国目前对于此方面研究颇有成果的学者的观点以及较之与哲学上因果关系的区分,对于在实践中如何看待、确定刑法因果关系做了简要分析,阐述一点不成熟的个人意见。
The causal relationship in the criminal law differs from the philosophical causal relationship because the causal relationship in the criminal law is to clarify the connection between a specific act and the result of the damage. The clear definition of this particular causal relationship is a prerequisite for determining that the ultimate actor should be punished by criminal law. The law does not penalize a perpetrator who has nothing to do with the endangering result and does not easily rule out the possibility of penalties for a perpetrator of the act that endangered the result. Therefore its requirement is more strict than philosophical causality and can not be neglected. By affirming China’s current scholars’ views on this area as well as its distinction from philosophical causality, this article makes a brief analysis of how to treat and determine the causal relationship in criminal law in practice, and elaborates on some immature personal opinions .
