自1990年开始,我国就颁布了一系列法律、法规,明确了计算机软件受著作权法保护;1994年,又把关于侵犯著作权犯罪上升到了刑事制裁;1997年则直接写入了刑法。同年,国家版权局通过设立举报电话等手段,查封取谛了一批光盘地下生产线,曾一度有力地扼制了盗版现象。1999年,国务院办公厅转发了国家版权局《关于不得使用非法复制的计算机软件的通知》,要求各省、自治区、直辖市人民政府,国务院各部委和各直属机构认真贯彻执行。在政府多次严厉打击下,盗版现象受到抑制,但它就像田中的杂草,每次清除后,一遇合适的温度和湿度就又滋生开来,真可谓屡禁不止,那么,原因何在?政府究竟应采取什么措施来解决这个问题?
Since 1990, China has promulgated a series of laws and regulations, which make it clear that the computer software is protected by the copyright law. In 1994, it again raised the criminal sanctions on crimes of copyright infringement; in 1997, it directly incorporated the criminal law. In the same year, the State Copyright Administration, through the establishment of whistleblower phones and other means, seized a batch of CD-ROM underground production lines and once effectively curbed piracy. In 1999, the General Office of the State Council forwarded the Notice of the State Copyright Administration on the Use of Computer Software That Do Not Use Illegal Copies, and urged the people’s governments of all provinces, autonomous regions and municipalities directly under the Central Government, the ministries and commissions under the State Council and the agencies directly under the Central Government to seriously implement the Circular. Under repeated crackdowns by the government, the phenomenon of piracy has been dampened. However, it is like Tanaka’s weeds. After each removal, once the proper temperature and humidity have breed, it is indeed repeated. So why? The Government What should be done to solve this problem?
