日本检察审查会制度与我国人民监督员制度虽然在诸多方面有所不同,但在审查不起诉决定正确与否、保障检察权公正实施等方面有相似之处。为确保人民监督员所作决议客观、公正,首先应确立人民监督员的独立性,并在此基础上强调参加成员的广泛性。同时,还应赋予人民监督员监督决议以法律效力。 Although there are differences in many aspects between Japan’s procuratorial review system and our people’s supervisor system, there are similarities in examining whether the non-prosecution decision is correct or not and that the prosecutorial power is implemented fairly.
