我国农村集体土地所有权主体——农民集体现行的三级所有制造成农村土地权属混乱,导致集体土地所有权主体不明、主体虚位。本文从促进农村土地市场发展同时兼顾保障农民集体所有权权益的视角出发,分别对三级农民集体是否适宜作为集体土地所有权主体展开论证,认为村级农民集体是作为集体土地所有权主体的合理选择,村民小组虽不宜作为产权主体但仍需保留并作相应改进。本文的研究为合理选择集体建设用地所有权主体提供了有益的研究依据。
The main body of rural collective land ownership in China - the current three-level ownership of peasant collectives creates chaos in the ownership of rural land, resulting in unclear ownership of the collective land and the main body. This article from the perspective of promoting the development of rural land market, taking into account the protection of peasants’ rights of collective ownership from the perspective of whether the three-level peasant collective suitability as the main body of collective land argumentation that the collective peasant community as a reasonable choice of the main body of collective land ownership, Although the group should not be the subject of property rights, it still needs to be retained and improved accordingly. The research in this paper provides a useful basis for the reasonable choice of the subject of collective construction land ownership.
