公安机关人民警察站在国家和社会的层面,一直是捍卫公权力的忠诚卫士,执法中暴露出许多弊端。宪法的修改,扩大了私权的范围,更加强调了对人权的保护,公安机关将面临执法观念落后、私法与公法的冲突加剧、警察权益保护滞后三大困境。公安机关应尽快摆脱执法困境,适应现代法治的需要。 At the level of state and society, the people’s police of the public security organ has always been a loyal guard who defends public power, exposing many drawbacks in law enforcement. The revision of the Constitution expanded the scope of private rights and more emphasized the protection of human rights. Public security organs will face the backward concept of law enforcement, the conflict between private law and public law will be aggravated and the protection of police rights and interests lags behind the three plight. Public security organs should get rid of the difficulties of law enforcement as soon as possible and adapt to the needs of the modern rule of law.
