上海市人民政府修改后的《上海市土地使用权出让办法》,自今年7月1日起施行。该办法修改的内容最重要的是两点:一是除《中华人民共和国土地管理法》规定可以以划拨方式取得土地使用权的情形外,各类建设用地均应当以有偿使用方式取得土地使用权;二是用于商业、旅游、娱乐、金融、服务业、商业房等项目的土地使用权出让,应当通过招标、拍卖方式进行。上海土地使用权出让方式的的调整变化,是建立社会主义市场经济体制的客观要求,是深化土地使用制度改革的必然结果,也是贯彻实施最近国务院颁发的《关于加强国有土地资产管理通知》
Shanghai Municipal People’s Government revised the “Shanghai Land Use Rights Transfer Measures”, since July 1 this year will come into effect. The content of the amendment is the most important two things: First, except “Land Administration Law of the People’s Republic of China” provides that the transfer of land use rights can be obtained by way of the case, all types of construction land should be paid to obtain land use rights Second, the transfer of land use rights for commercial, tourism, entertainment, financial, service and commercial housing projects should be conducted through bidding and auction. The adjustment and change in the way of transferring land use rights in Shanghai is an objective requirement for establishing a socialist market economic system and an inevitable result of deepening the reform of the land use system. It also implements the “Circular on Strengthening the Management of State-owned Land Assets” issued recently by the State Council.
