近代中国著作权立法的被动盲动、著作权法具体制度构建中的粗放不协调导致表演者权实现之困。表演者权的个体性、小权利性决定了表演者权在当下集体管理视角下的逻辑展开必要和实践可能。发达国家表演者权的实现经验为中国表演者权实现提供了集体管理的生动借鉴。依据中国著作权集体管理的法律规定,筹建表演者权集体管理组织、建立表演者权集体管理组织和著作权集体管理组织联合收费,改组现有表演者行业组织,最终解决表演者权实现之困。
The passive blindness of the copyright legislation in modern China and the extensive incompatibility in the construction of the concrete system of copyright law have led to the realization of the perplexity of performers. The performer’s individuality and small rights determine the necessary and practical possibilities for the logic of performers in the current collective management perspective. The experience of realizing the performer’s rights in developed countries provides a vivid reference for the collective management of the realization of the rights of Chinese performers. According to the law of collective management of copyright in China, it is necessary to establish a collective management organization of performers, establish collective management organizations of performers and copyright collective management organizations to jointly charge fees, reorganize the existing performers ’trade organizations, and finally solve the difficulties of the realization of performers’ rights.
