作品著作权能否转让,理论界颇有争议,国外著作权立法亦规定不一,从而使这一问题成为学术研究和著作权交易,特别是著作权国际贸易中不可回避的理论和现实问题。笔者拟从两大法系的不同思想观念入手,运用比较的方法,将讨论的范围限定为该问题的出现及其产生的根源、立法上的一般规定、著作权转让的方式、著作权转让的限制以及我国著作权立法规定及其检讨。探讨的目的在于说明作品著作权转让是作者实现著作财产权的重要手段之一,且揭示该项制度无论在理论上还是实践上均有深入研究的必要性。 Whether the copyright of the works can be transferred or not is quite controversial in theorists and there are different provisions in foreign copyright legislation, so that this issue becomes an unavoidable theoretical and practical issue in academic research and copyright transactions, especially in the international trade of copyrights. The author intends to start from the different ideological concepts of the two major legal systems and use the comparative method to limit the scope of the discussion to the emergence of the problem and the root causes of the problem, the general legislative provisions, the mode of copyright transfer, restrictions on the transfer of copyright, Copyright Legislation and Its Review. The purpose of this study is to show that the transfer of copyright works is one of the most important means by which the author realizes the property rights of his works and reveals the necessity of further research on this system both in theory and in practice.
