船舶优先权是海商法中的一个概念。《海商法》第二十一条规定:“船舶优先权,是指海事请求人依照本法第二十二条的规定,向船舶所有人、光船承租人、船舶经营人提出的海事请求,对产生该海事请求的船舶具有优先受偿的权利。”那么,这个优先权究竟优先到什么程度呢?对此我国《海商法》有明确规定。根据《海商法》第二十五条第一款的规定:“船舶优先权先于船舶留置权受偿,船舶抵押权后于船舶留置权受偿。”也即,在船舶优先权、船舶留置权和船舶抵押权当中,最优先的是船舶优先权,其次是船舶留置权,再次才是船舶抵押权。
