近年来,日益泛滥的“傍名牌”现象已引起了社会各界的广泛关注,而目前一种新型的境外“傍名牌”现象也正在市场上愈演愈烈。所谓的境外“傍名牌”,就是利用内地与香港等地区分属不同的法律体系,在商标注册制度上存在着差异这一特点,将在内地享有相当知名度的商标在境外申请登记为其企业名称或企业名称的一部分,由此轻易地取得内地公司注册商标的影响力,再将其生产的产品直接在内地进行销售,从而进行不正当竞争的行为。笔者就最近发生的一起典型案件进行分析,以香港为例对两地在知识产权领域内的商标权与商号权上的冲突问题进行探讨,并提出相应的法律对策。
In recent years, the increasingly widespread phenomenon of “Pong name brand” has aroused widespread concern in the community. At present, a new phenomenon of “Pong name brand” overseas is also on the rise in the market. The so-called overseas “Pong name brand” refers to the fact that there are differences in the trademark registration system under the different legal systems of the Mainland and Hong Kong. The trademark that enjoys a good reputation in the Mainland is applied for registration as its business name Or part of the company name, thereby easily obtaining the influence of a registered trademark of a mainland company and selling the products it produces directly to the Mainland for unfair competition. The author analyzes the recent typical cases and takes Hong Kong as an example to discuss the conflicts between trademark rights and trade name rights in the field of intellectual property between the two places and put forward corresponding legal measures.
