《城市房屋拆迁管理条例》(以下简称《拆迁条例》)实施以来,对城镇化建设起到了巨大的推动作用。特别是《物权法》实施后,各地不时出现的“暴力拆迁”和“钉子户”现象,使得拆迁问题一次次成为舆论的焦点,也使《拆迁条例》几近沦为“恶法”的代名词。因此,2011年1月21日《国有土地上房屋征收与补偿条例》(以下简称《征收条例》)的出台将征收限定在基于公共利益的需要,并彻底抛弃“拆迁”这一非法律语词。但寄希望于名称的改变就能一劳永逸地解决征收所带来的问题,
