近年来,银行信贷资金监管公证业务在许多地区开展起来。取得了良好的效果。从2000年起,厦门市鹭江公证处又率先开展了房地产预售资金监管公证业务。这两项公证业务的开展,引起了国内法学界、金融界、房地产界的极大关注。为做好银行信贷资金监管和房地产预售资金监管等新型资金监管公证业务的学理研究和实践总结,研究和论证此类公证业务的可行性、法定性和实效性,确保该项公证业务合法、规范、健康的发展,充分发挥公证在防范金融风险、保护房地产业健康发展方面的作用,2002年3月12日至3月15日,中国公证员协会在福建省厦门市举办了资金监管公证业务研讨会。我们在编发本次研讨会理论综述的同时,还将以专题或其他形式继续编发研讨会上的优秀论文,也希望各界读者继续关注“资金监管”这一话题的继续深入。
