沈家本是晚清政府的司法要员，近代著名的法学家，这是中国法律史学界人所共知的。本文所论述的却是他与晚清教案一些鲜为人知的问题。１８９８年保定知府任上，亲自处理教案，据理力争，取得胜利。１９００年八国联军入侵中国、占领保定，在保定教案中失败的洋教士诬告他通“拳匪”，而被侵略联军拘囚，险些丧命。１９０２年任修订法律大臣后，惩于教案，本着“参考古今，博辑中外”的主旨，积极修订法律，促进了中国法律制度的近代化，一时被誉为“法家泰斗”。最后这一点，是本文论述的重点所在。 Shen Jiaben was a judicial official in the late Qing government and a famous jurist in modern times, which is well known to Chinese legal historians. What this article discusses is some of the lesser-known issues of his lesson from the late Qing dynasty. In 1898, Baoding prefect was appointed to deal with the lesson plans himself and argue for victory. In 1900, the Eight-Power Allied Forces invaded China and occupied the Baoding. The foreign priests who failed in the Baoding lesson planted false charges of “fist bandits” and were almost detained by the invading coalition forces. In 1902, after revising the Minister of Law, he punished the lesson plan and actively revised the law in the spirit of “reference to both ancient and modern times and editorial boards both at home and abroad.” It promoted the modernization of the legal system in China and was once known as the “Leader in Legalism.” This last point is the focus of this article.
