本文主要论述了中国体育赛事转播的网络盗版问题。北京奥运会期间,中国政府依据一系列特殊法规规章而非依据现行《著作权法》来禁止网络盗版,虽然取得了良好效果,但是中国《著作权法》能否为体育赛事的网络转播提供法律保护仍需进一步明确。作者的观点是:如果体育赛事的转播具备足够的独创性(即符合“以类似摄制电影的方法创作的作品”),则现行《中华人民共和国著作权法》可以且应当为体育赛事转播权提供法律保护。本章第二部分主要介绍了美国、欧洲等地针对体育赛事转播中的网络盗版问题的法律规定及相关案例,并分析了各国法院的应对方式。第三部分针对中国《著作权法》对于体育赛事转播的保护现状,着重讨论了体育赛事是否是中国《著作权法》保护的作品及体育赛事转播权是著作权还是邻接权这两个问题,并就北京奥运会的相关策略进行了总结分析。第四部分则从修改中国《著作权法》、采用网络反盗版新技术以及协调各国法律这三个方面提出了保护体育赛事转播权的有益建议。 This article mainly discusses the network piracy issues broadcast by Chinese sports events. Olympic Games related strategies were analyzed. The fourth part puts forward some useful suggestions on the protection of the right of broadcast of sporting events from three aspects: the revision of China’s Copyright Law, the adoption of new anti-piracy technologies and the harmonization of national laws.
