作为文化发展的重要一环,著作权制度的完善越来越受到重视。经济全球化带来更多的版权贸易,某些“非法”进入我国的境外影视作品造成行业秩序混乱。在一元保护模式下,不承认未通过审核作品的著作权,侵害了作者的利益,与“著作权自动取得原则”存在冲突。在这种情况下,《著作权法》做出了适当的修改,二元保护理论得到确认。该理论顺应了影视作品保护的国际化趋势,同时填补了相关理论研究空白,具有比较深远的意义。
As an important part of cultural development, the perfection of copyright system is getting more and more attention. Economic globalization has resulted in more copyright trade. Certain “illegitimate” foreign films and TV works that have entered our country have caused chaos in the industrial order. Under the unification protection mode, it is against the author’s interests not to admit that the copyright of the works has not passed the examination, which conflicts with the principle of automatic acquisition of copyright. Under such circumstances, the Copyright Law has been properly amended and the theory of binary protection has been confirmed. This theory conforms to the trend of internationalization in the protection of film and television works, and at the same time, it fills the blank of relevant theoretical research and has far-reaching significance.
