在加拿大,法院对专家意见证据的采用日益慎重,也就是说,较之以前,专家意见证据正遇到越来越大的抵制。为了赢得官司,当事人邀请专家参与正在进行的诉讼以强化己方的证明效力,通常情况下,提出专家意见证据是因为某些或某个证据具有不确定性。一方当事人希望法官从合法性和客观性的立场出发开展对案件事实的调查,而此种调查当然是建立在证明材料的基础之上,一方拥有的证明材料愈多,胜诉的可能性就愈大。所以,多数专家意见证据是诉讼过程中的一种介入证据,那么,此类证据本身就具有某种危险性。而且专家的介入有可能要求相对方披露本应该予以保密的信息和文件材料。
In Canada, the courts have increasingly adopted the evidence of expert opinion, which means that, as before, evidence of expert opinion is encountering an increasing resistance. In order to win a lawsuit, the client invites an expert to participate in an ongoing lawsuit to reinforce the validity of one’s own proof. Usually, evidence of expert opinion is presented because of some or certain evidence of uncertainty. One of the parties hopes that the judge will carry out the investigation of the facts of the case from the standpoint of legitimacy and objectivity. Of course, such investigation is based on the supporting materials. The more proof materials a party has, the greater the possibility of winning a lawsuit . Therefore, the majority of expert opinion evidence is a kind of evidence in the process of litigation, then, such evidence itself has some kind of danger. Moreover, the involvement of experts may require the counterpart to disclose the information and documents that should be kept confidential.
