《中华人民共和国人民检察院组织法》自1979年通过并实施以来,经历了1983年和1986年两次修正,至今已有近28个年头,组织法对检察机关的地位、作用、性质、职能、行使职权的程序和检察院的机构设置、人员的任免作出了规定,但是随着司法改革的不断深入推进,原有的规定已经不能适应新形势下对检察工作的要求,对诉讼监督职权的行使方式更是争议多年。为破解这一难题,文章从分析世界主要法治国家检察制度特点入手,探讨我国刑事诉讼监督职权配置中存在的问题,进而提出对人民检察院组织法进行相应修改完善的方向。

In order to solve this problem, the article analyzes the characteristics of the procuratorial system in the world’s major rule of law, and discusses the problems in the allocation of the powers of criminal procedure supervision in our country, and then proposes the direction of revising and perfecting the Organic Law of People’s Procuratorate.
