一、公正审判权的国际标准根据《公民权利与政治权利国际公约》、《世界人权宣言》以及联合国及其下设机构的其他规范性文件,任何人的人权都应当得到有效的保障,为此,每一个人在其个人权利发生争议或者破指控犯罪进,都有获得公正审判的权利。公正审判权可以说是联合国刑事司法准则确认的一项核心人权,其主要内容大体上归纳为以下七个方面:(一)平等的法律保护权平等的法律保护权是指所有的人在法庭面前一律平等,有权受到法庭依法提供的平等保护,它是法律面前人人平等这一法治社会的公理在司法领域的具体表现之一。这一权利在《公民权利与政治权利国际公约》第14条第1款中有明确的规定,也
