On July 5, 1985, the French Parliament passed Law 85-677. The purpose of this law is to improve and speed up the process of compensation for victims of road accidents. It is hoped that the new law will help put an end to the controversy that has lasted for more than half a century in the judiciary, namely the controversy over fault and causality in determining the liability for road accidents. However, the situation is far from improving. The new law, somewhat embarrassed in some respects, attempts to satisfy the defenders of both the principle of fault and the principle of no fault, and the result is ambiguous. This leaves a great deal of room for further debate. The title of this law of optimism shows its purpose: ”to improve the status of victims of road traffic accidents and to speed up the procedure of compensation proceedings." The Parliament expected that the introduction of such a system would result in most cases of road traffic accidents, not by the courts but rather It is up to the insurance company, which is actually what many members of the French Bar Association are concerned about. However, the results prove that this is not the case.
