近一年来,利用各种经济手段对房地产市场进行调控无疑是我国经济工作的重心。在采取房产税以及物业税等调控手段的呼声甚嚣直上的同时,各种不同的学说和观点也纷至沓来。其中,建设用地使用权适用批租还是年租的问题,也成为争论的焦点之一。鉴于德国地上权制度是世界范围内采纳年租制最为典型的土地制度,因此,笔者认为可以借助对德国地上权制度本身及其在德国经济制度中的地位和作用的分析,间接地回答批租还是年租的问题。在具体思路上,本文将从批租制的社会危害入手,通过对德国地上权制度的介绍引入对年租制的论述,进而根据我国当前社会的实际情况得出应当对我国建设用地使用权实行“年租+批租”混合地租模式的结论。
In the past year, the use of various economic means to regulate the real estate market is undoubtedly the center of our economic work.
