一、引言在我国,有关海洋油污损害赔偿基金的研究始于《1971年设立国际油污损害赔偿基金的国际公约》(以下简称《1971年基金公约》)。我国于1980年1月30日参加《1969年国际油污损害民事责任公约》(简称《1969年民事责任公约》)之后[2],开展了我国是否应当参加《1971年基金公约》的讨论。讨论的结果是,在我国当时是石油出口国的情况下,参加《1971年基金公约》利大于弊,但因不能解决向国际污染损害赔偿基金(International Fund for Compensation for Pollution

INTRODUCTION In our country, the research on the marine oil pollution damage compensation fund began with the International Convention on the Establishment of an International Fund for Oil Pollution Compensation in 1971 (hereinafter referred to as “the 1971 Fund Convention”). After China participated in the Civil Liability Convention of 1969 for Oil Pollution Damage (abbreviated as “Civil Liability Convention 1969”) on January 30, 1980, China started discussions on whether or not China should participate in the 1971 Fund Convention. The result of the discussion was that while our country was an oil exporter at the time, the benefits to the 1971 Fund Convention outweighed the disadvantages.
