据日本时事通信社报道,日本千叶县一名男子因手机丢失导致电子钱包内的大约290万日元(约合17.6万元人民币)被非法使用。于是,他将电子服务运营商告上法庭,要求赔偿其损失。2017年1月18日,日本东京高等法院否定了东京地方法院的一审判决,判定被告支付大约224万日元赔偿金。审判长小野洋一表示“:针对手机遗失后应采取的对应举措,服务商对客户没有起到周知作用。”
Japan’s Chusato reported that a man in Chiba Prefecture, Japan, lost his cell phone and caused about 2.9 million yen (about 176,000 yuan) in his wallet to be illegally used. He then sued the electronics service operator in court for damages. On January 18, 2017, the Tokyo High Court in Japan rejected the judgment of the Tokyo District Court in the first instance and found that the defendant had paid approximately 2.24 million yen in damages. Judge Aoyama one said: “For mobile phones should take corresponding measures after the loss, service providers did not play a known role for customers.”
