我国审前程序出现问题的一个重要的根源在于追诉机关自我授权的决策机制,这种机制不能有效地回应社会对程序正义的诉求,同时,以这种方案解决程序性争议的样态,由于过分追求决策的效率而缩减中间环节,单方的决策方案由于缺乏第三方的监督,极易引起程序性违法行为的产生,这一问题值得反思。对程序性问题的司法化解决方案是各法治国家的普遍做法,司法裁判式的决策机制由于遵循了三方构造的程序法理,优于二方构造的行政决策式机制,程序法治化的必然结果在于决策机制的司法化。
An important root cause of the problems in the pretrial procedure in our country lies in the self-authorized decision-making mechanism of the prosecutorial organs. Such a mechanism can not effectively respond to the social demands for procedural justice. At the same time, Pursuing the efficiency of decision-making reduces the intermediate links. The unilateral decision-making plan is extremely apt to arouse procedural irregularities because of the lack of supervision by third parties. This issue merits reflection. The judicial solution to the procedural issues is a common practice in all countries under the rule of law. Judicial referendum decision-making mechanism is superior to the administrative decision-making mechanism constructed by the two parties because of following the procedural jurisprudence of the tripartite structure. The inevitable result of the legalization of the procedure lies in Judicialization of decision-making mechanism.
