案情去年10月,李某等四人应聘到某建筑公司,公司在待遇方面提出,如果职工坚持要求办理社会保险的话,从职工工资中每月扣除300元。李某等觉得还是多拿点工资好,至于办不办社会保险,也没什么关系。于是双方签订了十年的劳动合同。在合同第五条中规定每月工资2000元(含社会保险费300元),对社会保险事宜公司不予负责。且说明社会保险包括基本养老保险、工伤保险、失业保险和生育保险等。
