食品安全规制目标的顺利实现需要借用市场的力量,运用私法的力量,更需要充分发挥好政府规制的威慑作用。近些年来,各国食品安全法在修订层面均以增加威慑为主要取向,但是如何能够实现最佳威慑,使法律规范与经济社会发展相适应,却值得从法学理论上进一步展开思考。要对执法模式进行重新反思,对执法力量的分配、罚款数额设定以及归责原则加以认真设计,中国的食品安全规制及其实施,仍然有需要改进的空间,进而才能真正实现最佳威慑。
The smooth realization of the goal of food safety regulation needs to borrow the power of the market and make use of the power of private law. It also needs to give full play to the deterrent effect of government regulation. In recent years, the food safety laws of all countries are mainly aimed at increasing deterrence at the revision level. However, how to achieve the best deterrence and adapt the legal norms to the economic and social development, it is worth further thinking from the jurisprudence. We must rethink the law enforcement model, design the distribution of law enforcement powers, set the amount of fines and imputation principles. China’s food safety regulations and their implementation still have room for improvement, so that the best deterrence can be truly achieved.
